BISMARCK, N.D. (AP) _ A judge has ruled that he will allow the statements of a man charged with murder to be included in a trial because the man kept talking to detectives after requesting he be allowed to speak to an attorney.
South Central District Judge Bruce Romanick has denied a request by the lawyer for 29-year-old Richard Whitman to suppress statements he made to investigators following a shooting in Beulah that left one man dead.
Whitman and 24-year-old Cody Borner are accused of going to a Beulah apartment January 31st and fatally shooting Michael Padilla. Timothy Padilla was wounded but survived.
In his ruling, Romanick wrote that Whitman appeared to understand his rights.
The trial for both men is scheduled to begin Monday.
